These materials are owned by or licensed to Linx Grow Supply and may be protected by copyright, trademark, database, unfair competition, and other applicable intellectual-property laws.

Except as permitted by law or expressly authorized by us, you may not:

• modify;

• sell;
• license;
• publicly display;
• create derivative commercial works from; or

our protected materials.

You may print or save reasonable portions of product instructions or growing information for your own lawful personal use.

They are not a substitute for situation-specific professional advice where such advice is reasonably required.

Customers are responsible for considering the conditions applicable to their particular:

• plant;
• crop;
• soil;
• water;
• growing medium;
• property;
• climate; and
• production system.

Where appropriate, soil, water, tissue, or growing-media testing may provide more reliable information than general guidance.

17. Product Recommendation System

Linx Grow Supply may provide a recommendation tool or system designed to help customers identify potentially suitable products based on information such as:

• plant type;
• growth stage;
• observed symptoms;
• growing medium;
• intended use;
• nutrient goals; or
• other information supplied by the customer.

Recommendations are intended as a decision-support tool, not as a guarantee or definitive diagnosis.

A recommendation may be inaccurate or incomplete if:

• a symptom has multiple possible causes;
• soil or water conditions are unknown;
• multiple nutrient deficiencies produce similar symptoms;

Customers should evaluate recommendations against their actual growing conditions and product-specific instructions before applying a product.

18. Automated & AI-Assisted Recommendations

19. No Guaranteed Growing Results

Unless we expressly provide a written product-specific guarantee, Linx Grow Supply does not guarantee:

• germination;
• rooting;
• flowering;
• fruiting;
• plant growth rate;
• crop yield;
• colour development;
• nutrient-deficiency correction;
• lawn recovery;
• disease recovery;
• harvest quantity;
• harvest quality; or
• any particular growing result.

Plants are biological systems affected by numerous conditions outside our control.

Failure to achieve a desired horticultural result does not by itself establish that a product was defective.

20. Seeds & Germination

Seed germination and performance depend on numerous factors including:

• genetics;
• storage conditions;
• planting depth;
• planting date;
• soil temperature;
• moisture;
• light;
• dormancy;
• transplanting;
• weather;
• pests;
• disease; and
• cultivation practices.

Any germination information provided should be understood together with applicable product-specific information.

Unless expressly stated otherwise, the sale of seed does not constitute a guarantee that every seed will germinate or that every germinated plant will reach maturity.

Nothing in this section limits rights relating to seed that is materially defective, incorrectly supplied, misrepresented, or otherwise subject to mandatory legal protections.

Certain products we sell are natural, mined, biological, agricultural, or minimally processed materials.

Normal differences may occur between batches in:

• granule shape;
• density;
• texture;
• odour;

Such differences do not necessarily mean that the product is defective or materially different from its declared identity.

Products sold by weight or volume are supplied according to the declared net quantity rather than the apparent fullness of the package.

Compatibility between fertilizers, supplements, amendments, pesticides, concentrated nutrient salts, and other growing products can depend on:

• concentration;
• water chemistry;
• pH;
• mixing order;
• formulation;
• temperature; and
• other substances present.

Do not assume that two individually appropriate products can necessarily be mixed safely or effectively.

General website recommendations should not be interpreted as a representation that every combination of products is chemically or agronomically compatible.

25. Pest & Disease Claims

Unless a product is legally authorized and represented for pest-control use, references to plant nutrition, improved plant health, stronger growth, soil quality, or nutrient correction should not be interpreted as representing that the product is a:

must be understood according to the specific product information and applicable certification program.

A product's suitability for one organic standard does not necessarily mean it qualifies under every:

• certification body;
• jurisdiction;
• production standard; or
• farm-management program.

Customers operating certified organic farms or other certified production systems are responsible for confirming product eligibility with their applicable certification body before use.

27. Orders

Products displayed on the Site constitute invitations to customers to place orders and remain subject to:

• availability;
• acceptance;
• payment authorization;
• applicable law;
• shipping restrictions; and
• these Terms.

Submitting an order does not eliminate our ability, where legally permitted, to decline or cancel an order for legitimate reasons such as:

• inventory error;
• obvious pricing error;
• suspected fraud;
• payment failure;
• shipping restrictions;
• legal restrictions;
• unusual quantity;
• product discontinuation; or
• circumstances outside our reasonable control.

If we cancel a paid order, we will refund the affected amount as required.

If payment by commercial invoice is expressly approved, payment must be made according to the payment terms shown on the invoice or written agreement.

Any late charges or interest will apply only where expressly disclosed and legally permitted.

52. Customer Responsibility for Product Use

You are responsible for:

• observing applicable safety precautions;
• storing products properly; and
• complying with laws applicable to your use.

A customer who intentionally or negligently uses a product in a manner materially inconsistent with clear product instructions may bear responsibility for resulting harm to the extent provided by applicable law.

53. Indemnification

To the extent permitted by law, you agree to indemnify and hold Linx Grow Supply and its personnel harmless from third-party claims, liabilities, or reasonable costs arising directly from:

• content you submit that infringes another person's rights;
• your intentional unlawful use of the Site;
• fraud committed by you;
• your unauthorized resale or representation of yourself as affiliated with Linx Grow Supply;
• your violation of another person's intellectual-property rights; or
• commercial misuse of a product materially contrary to applicable law or clear product instructions.

This provision is not intended to transfer to a consumer responsibility for Linx Grow Supply's own wrongful conduct or for matters that cannot legally be shifted to the consumer.

• stopping sale;

• contacting affected customers;
• providing updated information;
• arranging a return; or
• implementing another appropriate remedy.

Customers should follow applicable recall instructions even if earlier website information or product materials state otherwise.

55. Regulatory Compliance

Products regulated as fertilizers, supplements, pesticides, seeds, or other regulated horticultural products remain subject to applicable legislation and regulatory requirements.

Nothing in these Terms should be interpreted as:

• exempting a product from a regulatory requirement;
• authorizing sale of an unlawful product;
• permitting prohibited product claims;
• permitting use inconsistent with applicable product authorization; or
• replacing mandatory label information.

56. Force Majeure & Events Beyond Reasonable Control

To the extent permitted by law, we are not responsible for delay or failure caused by circumstances outside our reasonable control, which may include:

• severe weather;
• natural disasters;
• fire;
• flood;
• power failure;
• internet outage;
• cyberattack;
• labour disruption;
• carrier disruption;
• border closure;
• customs delay;
• government action;
• regulatory restriction;
• epidemic or public-health emergency;
• supply shortage; or
• interruption affecting key suppliers.

Where an affected order cannot reasonably be fulfilled, we will provide any refund or other remedy required under applicable law.

• commence legal proceedings;

• make a regulatory complaint; or
• use another remedy that applicable law protects.

After a dispute arises, the parties may voluntarily agree to mediation, arbitration, or another lawful dispute-resolution procedure.

60. Consumer Rights

These Terms are intended to operate together with applicable consumer-protection law, not replace it.

Nothing in these Terms waives, excludes, or reduces any:

• statutory warranty;
• statutory condition;
• right of cancellation;
• refund right;
• remedy for misrepresentation;
• procedural right; or
• other consumer protection

that applicable law does not permit a business to waive.

If a provision of these Terms conflicts with a mandatory consumer right, the mandatory right prevails to the extent of the conflict.

61. No Waiver

If we do not immediately enforce a provision of these Terms, that does not mean we permanently waive our right to enforce it.

A waiver of a particular breach does not automatically waive a later or different breach.

62. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be interpreted or limited to the minimum extent necessary where legally possible.

If it cannot be preserved, it will be severed.

The remaining provisions will continue to operate to the extent permitted by law.

constitute the agreement governing the matters they address.

They supersede prior general website terms relating to the same subject matter.

Nothing in this section overrides a separate written agreement expressly entered into between Linx Grow Supply and a customer for a particular transaction.

Section titles and headings are provided for convenience and readability.

They do not independently alter the meaning of the provisions they describe.

Words such as “including” and “includes” are intended to mean “including without limitation” unless the context clearly indicates otherwise.

Where applicable law requires a French version of a consumer agreement or standard-form contract to be made available before the agreement is concluded, Linx Grow Supply will comply with the applicable language requirements.
